This website is operated by Rockskins. Throughout the site, the terms “we,” “us,” and “our” refer to Rockskins.

Rockskins provides this website, including all information, tools, products and services available through the site, to you conditioned upon your acceptance of the terms, conditions, policies and notices stated here.

By visiting our website, purchasing a product, submitting artwork, requesting custom design services, or otherwise using our website or services, you agree to be bound by these Terms of Service and by any additional policies referenced on this website, including our Returns & Cancellations Policy, Privacy Policy and Shipping policies.

These Terms apply to all users of the website, including browsers, customers, purchasers, vendors and persons submitting artwork or other content to Rockskins.

Please read these Terms carefully before using our website or placing an order.

SECTION 1 — ONLINE STORE TERMS

By using this website, you represent that you are at least the age of majority in your province, state or jurisdiction of residence, or that you are the age of majority and have given permission for any minor dependents under your care to use this website.

You may not use our products, website or services for any illegal or unauthorized purpose.

You may not violate any applicable laws in your jurisdiction, including copyright, trademark and intellectual-property laws.

You must not transmit viruses, malware, worms or other destructive code.

A breach of these Terms may result in suspension or termination of your access to our services.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse service, decline an order or discontinue a transaction where reasonably necessary, including where we believe an order, submitted artwork, payment or requested use may violate applicable law, third-party rights, our policies or these Terms.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of this website or our services without our written permission.

Headings used in these Terms are provided for convenience and do not limit or otherwise affect the provisions contained within them.

SECTION 3 — PRODUCTS AND MADE-TO-ORDER PRODUCTION

Rockskins specializes in made-to-order drum wraps, guitar wraps, custom graphics and related products.

Many Rockskins products are manufactured specifically for the individual customer after an order is placed. We do not maintain finished inventory of most graphic products.

Because products are made to order, production may begin shortly after an order is received.

Customers are responsible for reviewing their order carefully before completing checkout, including:

product selection
graphic design
size
depth and diameter where applicable
guitar graphic dimensions
orientation
finish
colour
quantity
custom instructions

Products made to customer specifications may not be eligible for return, exchange or cancellation once production has begun, except where otherwise stated in our Returns & Cancellations Policy or required by applicable law.

SECTION 4 — MEASUREMENTS AND SIZING

Customers are responsible for providing and selecting accurate measurements when ordering Rockskins products.

For drum wraps, measurements must follow the sizing instructions provided by Rockskins, including the required Depth × Diameter format.

For guitar wraps and related graphics, customers must follow the applicable guitar measurement guide and select the appropriate graphic size, orientation and finish.

Rockskins is not responsible for incorrect fit resulting from measurements or product selections supplied incorrectly by the customer.

If you are uncertain about sizing, contact Rockskins before placing your order.

SECTION 5 — CUSTOM ARTWORK AND CUSTOMER-SUPPLIED CONTENT

Rockskins offers custom design and printing services.

When you submit photographs, artwork, logos, trademarks, graphics, illustrations, designs or other content to Rockskins, you represent and warrant that:

you own the submitted material; or
you have obtained all rights, licences and permissions necessary for Rockskins to reproduce and use that material for your order.

You authorize Rockskins to reproduce, resize, crop, colour-correct, position, modify and otherwise prepare submitted material as reasonably necessary to produce your requested product.

Rockskins is not responsible for determining ownership of customer-supplied artwork.

You agree that you will not submit material that infringes the copyright, trademark, publicity, privacy or other rights of any third party.

Rockskins reserves the right to refuse any submitted artwork or custom project that we reasonably believe may violate applicable law, third-party intellectual-property rights or our policies.

The customer assumes responsibility for claims arising from unauthorized use of submitted artwork or other protected material.

SECTION 6 — CUSTOM DESIGN SERVICES

Where Rockskins creates original custom artwork or design work at the customer’s request, additional design fees may apply.

The cost of custom design work will depend on the scope and complexity of the project.

Unless otherwise agreed in writing, design fees cover the creation and preparation of artwork and do not include the cost of the physical drum wraps, guitar wraps or other products ordered.

Rockskins may retain completed customer artwork files for use in future repeat orders or requested add-ons.

Design fees and completed custom design services are generally non-refundable once work has commenced.

SECTION 7 — CUSTOMER ARTWORK FILE REQUIREMENTS

Artwork supplied for custom production should meet Rockskins' current artwork specifications.

Accepted formats may include:

Submitted artwork should normally be at least 300 DPI at the required production size.

Low-resolution, undersized or compressed artwork may produce visible pixelation or reduced print quality.

Where Rockskins advises that submitted artwork is unsuitable for high-quality reproduction and the customer nevertheless authorizes production, the customer accepts the resulting print-quality limitations.

SECTION 8 — COLOUR AND IMAGE REPRESENTATION

We make reasonable efforts to display product colours and images accurately.

However, colours may vary between:

computer monitors
mobile devices
digital proofs
printed materials
production batches

Screen colour is not a guarantee of exact printed colour.

Minor variations in colour, crop, positioning or visual appearance that result from normal printing and manufacturing tolerances do not necessarily constitute a product defect.

SECTION 9 — PRODUCT DESCRIPTIONS AND AVAILABILITY

We reserve the right to:

modify product descriptions
change product pricing
discontinue products
change product options
correct errors
limit quantities
refuse or cancel orders where necessary

Any product or service may be discontinued without notice.

We do not guarantee that every product shown on the website will remain available indefinitely.

SECTION 10 — PRICING

Prices are subject to change without notice.

Prices shown at the time an order is completed will generally apply to that order unless a pricing, technical or obvious data-entry error has occurred.

Rockskins reserves the right to correct pricing errors and, where necessary, cancel or refund an affected order.

Currency displayed may vary depending on customer location or store settings.

SECTION 11 — PAYMENT AND BILLING INFORMATION

You agree to provide current, complete and accurate billing and account information for all purchases.

You agree to update information as necessary so that we can process your order and contact you regarding your purchase.

We reserve the right to refuse or cancel orders that appear fraudulent, unauthorized, commercially abusive or otherwise inconsistent with these Terms.

Where an order is cancelled by Rockskins, any applicable refund will be processed in accordance with the circumstances of the order and our policies.

SECTION 12 — SHIPPING, DELIVERY, DUTIES AND TAXES

Shipping estimates are provided in good faith but are not guaranteed delivery dates.

Rockskins is not responsible for carrier delays, customs delays, weather events, transportation interruptions or other circumstances outside our reasonable control.

Customers are responsible for ensuring that the shipping address entered at checkout is complete and accurate.

Where applicable, taxes, duties, tariffs, brokerage charges or import fees may be assessed according to the destination country and the shipping method used.

Any such charges not collected by Rockskins at checkout remain the responsibility of the customer unless otherwise stated.

SECTION 13 — RETURNS, CANCELLATIONS AND REFUNDS

Returns, cancellations and refunds are governed by the Rockskins Returns & Cancellations Policy.

Because many Rockskins products are made to order or customized to customer specifications, return and cancellation rights may differ from those applicable to ordinary stocked retail goods.

Customers should review the Returns & Cancellations Policy before placing an order.

Gift cards, completed custom design services and personalized or made-to-order items may be non-returnable except where required by law.

SECTION 14 — INTELLECTUAL PROPERTY

Unless otherwise stated, the Rockskins name, branding, website design, product presentation, original graphics, photographs, text and other content created by Rockskins are owned by or licensed to Rockskins.

Nothing on this website grants users a licence to reproduce or commercially exploit Rockskins intellectual property without written permission.

Customer-supplied artwork remains subject to the ownership rights of its lawful owner.

SECTION 15 — USER COMMENTS, REVIEWS AND SUBMISSIONS

If you submit reviews, testimonials, photographs, comments or other materials to Rockskins, you confirm that you have the right to submit that material.

You agree that your submissions will not violate the rights of any third party, including copyright, trademark, privacy, publicity or other proprietary rights.

You remain responsible for the accuracy and legality of material you submit.

Rockskins may remove content that we reasonably consider unlawful, abusive, misleading, infringing or inappropriate.

Where you separately grant Rockskins permission to use customer photographs, testimonials or finished-project images for marketing or promotional purposes, we may use those materials in accordance with that permission.

SECTION 16 — OPTIONAL AND THIRD-PARTY TOOLS

Rockskins may provide access to third-party services, apps, payment processors, shipping providers or other tools.

These services may be operated independently of Rockskins.

Your use of third-party services may also be subject to the terms and privacy policies of those providers.

We are not responsible for third-party services beyond the extent required by applicable law.

SECTION 17 — THIRD-PARTY LINKS

This website may contain links to websites operated by third parties.

Rockskins is not responsible for the content, accuracy, privacy practices, products or services of third-party websites.

You should review the applicable policies and terms of third-party websites before using them or completing transactions through them.

SECTION 18 — PERSONAL INFORMATION

Your submission and use of personal information through the Rockskins website is governed by our Privacy Policy.

Payment information is processed through secure payment systems provided by Shopify and/or applicable third-party payment processors.

SECTION 19 — ERRORS, INACCURACIES AND OMISSIONS

From time to time, information on the website may contain typographical errors, inaccuracies or omissions relating to:

product descriptions
pricing
promotions
shipping
production times
availability
sizing
product specifications

We reserve the right to correct such errors and update information without prior notice.

Where an error materially affects an order that has already been placed, we may contact the customer to determine the appropriate resolution.

SECTION 20 — PROHIBITED USES

You may not use this website or its content:

for unlawful purposes
to violate applicable laws or regulations
to infringe intellectual-property rights
to submit fraudulent or misleading information
to transmit malware or destructive code
to collect personal information unlawfully

We reserve the right to terminate access to the website or services where these restrictions are violated.

SECTION 21 — DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the website and services are provided on an “as is” and “as available” basis.

We do not guarantee that the website will always operate without interruption or error.

Nothing in these Terms excludes any warranty, condition or consumer right that cannot legally be excluded under applicable law.

SECTION 22 — LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Rockskins and its owners, directors, employees, contractors, service providers and affiliates will not be liable for indirect, incidental, special, punitive or consequential damages arising from use of the website, products or services.

Where liability cannot legally be excluded, Rockskins' liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms limits liability where such limitation is prohibited by law.

SECTION 23 — INDEMNIFICATION

You agree to indemnify and hold harmless Rockskins and its owners, employees, contractors, service providers and affiliates from claims, losses, liabilities, costs and reasonable legal expenses arising from:

your violation of these Terms
your violation of applicable law
your infringement of third-party rights
unauthorized artwork or content submitted by you
misuse of Rockskins products or services

This provision applies only to the extent permitted by applicable law.

SECTION 24 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

SECTION 25 — TERMINATION

These Terms remain effective until terminated.

You may stop using our website and services at any time.

Rockskins may suspend or terminate access where we reasonably believe a user has violated these Terms or applicable law.

Rights and obligations that arose before termination will survive where appropriate.

SECTION 26 — ENTIRE AGREEMENT

These Terms, together with the policies referenced on the Rockskins website, constitute the agreement between Rockskins and users regarding use of the website and services.

Any failure by Rockskins to enforce a provision of these Terms does not waive our right to enforce that provision later.

SECTION 27 — GOVERNING LAW

These Terms and any separate agreements through which Rockskins provides products or services will be governed by and interpreted in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Nothing in this section removes any mandatory consumer rights that apply under the laws of a customer's jurisdiction where those rights cannot legally be waived.

This replaces the malformed governing-law sentence in the current Terms, which presently refers to “the laws of Rockskins” followed by the business address.

SECTION 28 — CHANGES TO THESE TERMS

We reserve the right to update, change or replace these Terms by posting revisions on this website.

Changes become effective when posted unless otherwise stated.

Continued use of the website after changes are posted constitutes acceptance of the revised Terms to the extent permitted by law.
